Gov. Andrew Cuomo Passes New Ethics Bill

There has been a new development in the lawsuit against JCOPE’s advisory opinion, which PRSA, the PR Council and the Arthur W. Page Society supported with affidavits.  While the lawsuit was making its way through the courts, Gov. Andrew Cuomo passed a new ethics bill.  This bill agrees with PRSA’s statement that the JCOPE advisory opinion overreached.
The new legislation specifically excludes “communications with a professional journalist, or newscaster, including an editorial board or editorial writer of a newspaper, magazine, news agency, press association, or wire service, relating to news.”  As well as “communications relating to confidential and non-confidential news…and communications made pursuant to community outreach efforts for broadcast stations required by federal law.” This new legislation takes effect immediately. 
The parties involved in the lawsuit against the JCOPE ruling have been asked to provide a briefing on the impact of this new law, which is due on Aug. 8.
